Terms of Service

1. Acceptance

By accessing or using tesseracttrucking.com or any related service operated by Tesseract Trucking ("we", "us", "Tesseract"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the service.

2. The service

We operate a marketing website, a freight quote intake, a driver application intake, and a private driver portal where active contractor drivers can view settlements, upload reimbursable expense receipts, and manage their account. These terms govern your use of all of these features. Separate written agreements (lease/operating agreements, broker–carrier agreements, freight tenders, etc.) govern any commercial relationship between you and Tesseract Trucking; in case of conflict, the signed agreement controls.

3. Eligibility

You must be at least 18 years old and able to form a legally binding contract. By using the service you represent that the information you provide is accurate and current.

4. Driver applications and engagements

The driver application is for prospective independent-contractor drivers. Submitting an application is not an offer of engagement and creates no obligation on either party. Hiring decisions are made at our sole discretion based on application content, required background and motor vehicle reports (after your written consent), DOT compliance, fit, and operational need.

Drivers we engage operate as 1099 independent contractors under separate written agreements, not as employees. Nothing on this site or in the application creates an employment relationship.

5. Account security (driver portal)

We use email magic-link sign-in for the driver portal — there is no password to remember. Keep your email account secure; anyone with access to your email can sign into your portal. Notify us immediately if you suspect unauthorized access. You are responsible for activity that occurs under your account.

6. Acceptable use

When using the site or any related service, you agree not to:

  • Submit false, misleading, or fraudulent information (especially in the driver application).
  • Upload files that contain malware or that you don't have the right to share.
  • Attempt to circumvent authentication, rate limits, or bot protection.
  • Scrape, copy, or republish site content without our written permission.
  • Use the service to harass, threaten, or harm others.
  • Probe, scan, or test the vulnerability of any system or network without authorization.

7. Intellectual property

The site, brand, copy, and design are owned by Tesseract Trucking and are protected by copyright and trademark laws. Public-facing content is licensed to you for personal, non-commercial reference only. You retain ownership of information and documents you submit (driver applications, receipts, etc.); you grant us a license to use them solely to operate the service and as otherwise described in our Privacy Policy.

8. Quote requests and shipments

A quote request submitted through the site is not a binding agreement. We may decline any load. Pricing, availability, and service terms are governed by the broker–carrier agreement and the rate confirmation for each individual shipment.

9. Third-party links

The site may link to third-party services (e.g., Discord, Highway.com badges). We are not responsible for the content, terms, or privacy practices of those services.

10. Disclaimer of warranties

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Tesseract Trucking disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the site will be uninterrupted, error-free, or completely secure.

11. Limitation of liability

To the maximum extent permitted by law, Tesseract Trucking will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or relating to your use of the service. Our total liability for any claim relating to the service is limited to the greater of (a) the amounts you paid us in the twelve months preceding the claim, or (b) one hundred US dollars (USD $100). Nothing here limits liability that cannot be limited under law.

12. Indemnification

You agree to indemnify and hold Tesseract Trucking harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your violation of these terms, your misuse of the service, or your infringement of any third-party right.

13. Termination

We may suspend or terminate your access to the site or driver portal at any time, with or without notice, for any reason — including violation of these terms or a separate written agreement. Upon termination, your right to use the service ends; surviving provisions (intellectual property, disclaimers, limitations of liability, indemnification, governing law) remain in effect.

14. Governing law and venue

These terms are governed by the laws of the State of California, excluding its conflict-of-laws principles. Any dispute arising out of or relating to these terms or the service shall be brought exclusively in the state or federal courts located in San Bernardino County, California, and you consent to personal jurisdiction in those courts.

15. Changes

We may update these terms as our practices, services, or applicable laws change. The "Last updated" date at the top reflects the most recent version. Continued use after changes are posted constitutes acceptance of the updated terms.
